Terms of Service

CliniPearls — operated by Beverley Care Ltd

Effective date: 14 August 2026

Version: 1.0

In short

  • CliniPearls helps you capture clinical learning at the point of care and turn it into portfolio-ready evidence.
  • It is a documentation tool. It is not a medical device, not clinical decision support, and not a patient record.
  • It is not affiliated with the GMC, any Royal College, or any ePortfolio provider. It prepares material for those systems; it does not replace them.
  • It is built for anonymised content only. You must not enter patient identifiers, and you must check output before you use it.
  • AI output is a first draft. You review it, you own it.
  • Subscription only, renewing automatically. You can cancel any time and keep access to the end of the period you paid for.
  • The full terms below are what you agree to. Where a plain-English summary and the detailed clause differ, the detailed clause applies.

1. Who we are and what you're agreeing to

These Terms of Service ("Terms") are a contract between you and Beverley Care Ltd, a company registered in England and Wales (company number 15459104), registered office 311 Regents Park Road, London N3 1DP, trading as CliniPearls ("we", "us", "our").

They govern your use of CliniPearls at https://clinipearls.com (the "Service").

By creating an account or using the Service you confirm you have read and agree to these Terms and to our Privacy Policy, which forms part of them. If you do not agree, do not use the Service.

2. Who may use CliniPearls

The Service is for qualified healthcare professionals and those in recognised training or professional roles — including doctors, specialty trainees, foundation doctors, GP trainees, SAS doctors, locally employed doctors, and advanced practitioners.

To use it you must:

  • be at least 18 and able to enter a binding contract;
  • hold current registration with a relevant professional regulator, or otherwise be permitted by us in writing; and
  • use the Service for your own professional development, portfolio, or educational purposes.

Your employer's rules are your responsibility. You must satisfy yourself that your use of the Service complies with the information governance, confidentiality, and acceptable-use policies of any employer, Trust, health board, or other organisation you are subject to. We do not warrant that the Service is approved for use by any particular NHS organisation or employer, and we do not seek or hold such approvals on your behalf.

One account is for one person. You may not share your account.

3. What the Service is — and is not

3.1 Not a medical device; not for clinical decisions. CliniPearls is a documentation and professional-development tool. It is not intended to diagnose, treat, monitor, or prevent any disease or condition, is not a medical device, and must not be used to make or support any decision about the care of any patient. Nothing it produces is medical advice.

3.2 Not a clinical record. The Service is not a patient record system and must not be used as one. It forms no part of any patient's medical record. You remain solely responsible for keeping contemporaneous clinical records in your organisation's approved systems.

3.3 Not a substitute for mandatory systems. CliniPearls is an upstream aid that helps you prepare content for entry into mandatory Royal College ePortfolios, appraisal systems, and applications. It does not replace them. Your obligation to maintain your official ePortfolio and records is unchanged.

3.4 No affiliation. We are not affiliated with, endorsed by, partnered with, or approved by the General Medical Council, any Royal College, JRCPTB, ISCP, RCEM, or any ePortfolio provider. References to those bodies, their curricula, or their assessment frameworks are descriptive only.

3.5 No guarantee of outcome. We do not promise that using the Service will result in any piece of evidence being accepted, any assessment being signed off, specialist registration being granted, or any other outcome in any application, appraisal, revalidation, or assessment process. Those decisions belong entirely to third parties.

3.6 AI output may be wrong. The Service uses artificial intelligence to transcribe, structure, summarise, classify, and tag what you capture. Output may be inaccurate, incomplete, mis-categorised, or misleading. You are solely responsible for reviewing, verifying, and correcting all output before you rely on it or enter it into any other system. We do not warrant the accuracy or suitability of any AI output.

4. Anonymisation and patient information — your responsibility

This is the most important section in these Terms. Please read it carefully.

4.1 The Service is for anonymised content only. You must not enter, upload, dictate, photograph, or otherwise input any patient-identifiable information. This includes names, initials, dates of birth, addresses, postcodes, NHS numbers, hospital or record numbers, dates of admission or attendance where they could identify someone, images showing identifying features or document headers, and any combination of details that could reasonably identify an individual.

4.2 What we do technically. The Service is built to remove or reduce identifiers at the point of extraction, before any record is written to our database. In addition:

  • voice capture is transcribed on your own device using your browser's built-in speech recognition — no audio file is created, sent to us, or stored;
  • photographs are processed in memory to extract text and are then discarded — the image itself is not written to our storage or database.

4.3 These measures are an aid, not a guarantee. No automated system can guarantee that every identifier is removed in every case. You must not treat identifier removal as a substitute for your own judgement.

4.4 You remain responsible. As the healthcare professional entering the information, you are responsible for:

  • ensuring no patient-identifiable information is entered into the Service;
  • reviewing all captured, structured, and output content to confirm it is genuinely anonymised before you save it, export it, copy it, or enter it into any other system; and
  • complying at all times with your professional duty of confidentiality, including GMC guidance and any equivalent, and with your employer's information governance policies.

4.5 Your professional duty is not transferred. Nothing in the Service or these Terms relieves you of, reduces, or transfers away your personal and professional duty of confidentiality to patients. That duty remains yours alone.

4.6 Limitation. Subject to clause 8.1, and to the maximum extent the law permits, we are not liable for any consequence — including any breach of confidentiality, regulatory action, disciplinary process, or claim — arising from patient-identifiable information being entered into the Service by you or on your behalf in breach of clause 4.1, or from your failure to review content as required by clause 4.4(b).

5. Your account and acceptable use

5.1 You must give accurate registration details and keep them current. You are responsible for keeping your credentials confidential and for everything done under your account. Tell us immediately at contact@clinipearls.com if you think your account has been accessed without your authorisation.

5.2 You must not:

  • use the Service unlawfully or for any unlawful purpose;
  • enter patient-identifiable information (see Section 4);
  • submit any third party's personal data without a lawful basis for doing so;
  • attempt to access another user's data, or any part of the Service or underlying system, without authorisation;
  • probe, scan, disrupt, or place unreasonable load on the Service, or attempt to circumvent any access control, usage limit, or paywall;
  • reverse engineer, decompile, scrape, or copy any part of the Service except as the law allows;
  • resell, sublicense, or make the Service available to anyone else;
  • use the Service or its output to build, train, or improve any competing product or machine learning model; or
  • upload malicious code, or anything that infringes another person's rights.

5.3 We may suspend or close accounts that breach these Terms, are held by ineligible users, or where we reasonably need to act to protect the Service or other users.

6. Subscriptions, payment, and cancellation

6.1 Trial. We may offer a time-limited trial. When it ends, continued access requires a paid subscription. There is no permanent free tier.

6.2 Plans and prices. Access requires a paid subscription at the prices shown at clinipearls.com at the time you subscribe, on a monthly or annual basis. The price, billing frequency, and renewal terms that apply to you are those displayed at checkout.

6.3 Payment. Payments are processed by Stripe. We never receive or store your full card details. By subscribing you also accept Stripe's terms. You authorise recurring charges to your chosen payment method.

6.4 Automatic renewal. Subscriptions renew automatically at the end of each billing period at the then-current price for your plan, unless you cancel before the renewal date. We will give reasonable advance notice of any price change affecting your renewal.

6.5 VAT and taxes. Prices are shown inclusive or exclusive of VAT as stated at checkout. Where VAT or an equivalent tax applies, it is charged in addition unless stated otherwise.

6.6 Cancelling. You may cancel at any time in your account settings or by emailing us. Cancellation stops future renewals. You keep access until the end of the period you have already paid for.

6.7 Your 14-day right to cancel. If you are a consumer, you have a statutory right to cancel within 14 days of subscribing. Because the Service is supplied digitally and you get access straight away, you expressly request supply to begin immediately and acknowledge that:

  • once the Service has been fully supplied for the period, you lose the right to cancel that period; and
  • where supply has begun but is not complete, we may deduct a proportionate amount for the access you have had, and refund the balance.

To cancel under this clause, email contact@clinipearls.com within 14 days.

6.8 Refunds otherwise. Outside clause 6.7 and your other statutory rights, subscription fees are non-refundable, though we may make exceptions at our discretion.

6.9 Failed payment. If a payment fails we may suspend access until it is resolved.

6.10 Business purchases. If you subscribe in the course of a business, or your employer or organisation subscribes on your behalf, clause 6.7 does not apply and the Consumer Rights Act 2015 does not apply to that purchase.

7. Your content, our platform

7.1 You own your content. You keep full ownership of everything you enter or upload. You grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, process, and transmit it solely to provide and support the Service to you, as described in our Privacy Policy. That licence ends when your content is deleted.

7.2 We do not train models on your content. We do not use your content to train artificial intelligence or machine learning models, and our arrangements with our AI provider prohibit the use of your content to train their models.

7.3 We own the platform. All content, features, and functionality of the Service — software, design, structure, templates, branding, logos, and documentation — belong to Beverley Care Ltd or our licensors. This does not include anything you enter or upload. You get a limited, revocable, non-exclusive, non-transferable licence to use the Service under these Terms for as long as your subscription lasts.

7.4 Feedback. If you send us suggestions, we may use them freely and without obligation to you.

8. Liability

8.1 What we never exclude. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. If you are a consumer, nothing in these Terms affects your statutory rights.

8.2 Subject to clause 8.1, and to the fullest extent the law permits:

  • the Service is provided "as is" and "as available", and we exclude all implied warranties;
  • we are not liable for loss arising from AI output you did not review, for any decision of a regulator, Royal College, employer, assessor, or ePortfolio provider, or for any disclosure of confidential information arising from content you entered or output you exported;
  • we are not liable for indirect or consequential loss, loss of profit, loss of business, loss of opportunity, loss of professional standing, or loss of portfolio or appraisal outcomes; and
  • we are not liable for loss or corruption of data to the extent you have not kept your own copies.

8.3 Cap. Subject to clause 8.1, our total aggregate liability arising out of or in connection with these Terms, whether in contract, tort (including negligence), or otherwise, is limited to the greater of (i) the total fees you paid us in the 12 months before the event giving rise to the claim, or (ii) £500.

8.4 Business users. If you use the Service in the course of a business, you agree these limitations are reasonable, and you will indemnify us against any claim, loss, liability, or cost arising from your breach of Section 4 or Section 5.

9. Availability, changes, and support

We aim for a reliable Service but do not guarantee it will be uninterrupted, error-free, or always available. Access may be affected by maintenance, updates, third-party failures, or events outside our control.

We may add to, change, or withdraw features. Where a change materially reduces core functionality of a plan you have paid for, we will give reasonable notice and, where appropriate, refund the unused prepaid portion.

Support is by email at contact@clinipearls.com on a reasonable-endeavours basis.

10. Data protection

We process personal data as set out in our Privacy Policy, and apply the measures set out in our Security Statement. Both form part of these Terms.

For your account and billing information, Beverley Care Ltd is the data controller. The Service is designed so that the case content we store is anonymised and therefore outside personal-data rules; where content momentarily exists in identifiable form before anonymisation, we act on your instructions in respect of that transient processing. You confirm that you have a lawful basis for anything you submit and that you are meeting your own data protection obligations.

11. Ending your use, and getting your data out

11.1 You may close your account at any time.

11.2 We may suspend or end your access immediately if you materially breach these Terms, if the law requires it, or if we reasonably believe your use puts the Service or others at risk. We may also end this agreement for convenience on 30 days' notice, refunding any unused prepaid fees.

11.3 Export before you go. Export anything you want to keep before closing your account. After closure we delete or anonymise your content in line with the retention periods in our Privacy Policy. Do not rely on the Service as your only copy of anything you need.

11.4 If we discontinue the Service entirely, we will give reasonable notice and a window in which to export your content.

12. General

  • Changes to these Terms: We may update these Terms. Where a change is material we will notify you by email or in-app before it takes effect. Continuing to use the Service after that date means you accept the change. If you do not accept a material change, you may cancel and ask for a pro-rata refund of any unused prepaid period.
  • Whole agreement: These Terms, the Privacy Policy, and the Security Statement are the entire agreement between us.
  • Transfer: You may not transfer your rights. We may transfer ours, including to a successor on a reorganisation, merger, or sale of the business, and will tell you if we do.
  • Severance: If any provision is unenforceable, the rest stays in force.
  • No waiver: Delay in enforcing a provision does not waive it.
  • Third parties: These Terms create no rights for anyone else.
  • Governing law: These Terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the UK, you may also bring proceedings in your local courts.
